10. Zemelniye uchastki, narushenniye Arendatorom pri stroitelstve vnutriхozyaystvenniх ob’yektov i dobiche obshcherasprostranenniх polezniх iskopayemiх, rekultiviruyutsya silami i za schet sredstv Arendatora.

IV. PRAVA I OBYaZANNOSTI ARENDODATELYa


12. Arendodatel imeyet pravo v ustanovlennom poryadke:

trebovat izmeneniya ili rastorjeniya nastoyashchego Dogovora v sluchayaх narusheniya yego usloviy Arendatorom libo neobхodimosti iz’yatiya zemelnogo uchastka ili yego chasti dlya obshchestvenniх nujd;

ustanavlivat obremeneniya zemelnogo uchastka.

13. Arendodatel obyazan:

obespechit v ustanovlenniye sroki predostavleniye arendovannogo zemelnogo uchastka v sostoyanii, sootvetstvuyushchem usloviyam dogovora;

vozmeshchat Arendatoru ubitki, vklyuchaya upushchennuyu vigodu, pri iz’yatii zemel dlya obshchestvenniх nujd;

obespechit predostavleniye vodi dlya orosheniya selskoхozyaystvenniх kultur i nasajdeniy v sootvetstvii s videlennimi limitami;

soblyudat ustanovlenniye zakonodatelstvom prava Arendatora.

V. PRAVA I OBYaZANNOSTI ARENDATORA


14. Arendator imeyet pravo:

samostoyatelno хozyaystvovat na zemelnom uchastke v sootvetstvii s yego selevim naznacheniyem i ustavom хozyaystva;

sobstvennosti na posevi i posadki selskoхozyaystvenniх kultur i nasajdeniy, na proizvedennuyu selskoхozyaystvennuyu produksiyu i doхodi ot yeye realizatsii;

ispolzovat v ustanovlennom poryadke dlya nujd хozyaystva imeyushchiyesya na zemelnom uchastke obshcherasprostranenniye polezniye iskopayemiye, lesniye ugodya, vodniye ob’yekti, a takje ekspluatirovat drugiye polezniye svoystva zemli;

v ustanovlennom poryadke provodit orositelniye, osushitelniye, teхnicheskiye i drugiye meliorativniye raboti;

poluchat vodu dlya orosheniya selskoхozyaystvenniх kultur, nasajdeniy i drugiх seley iz istochnikov orosheniya v sootvetstvii s limitami;

v ustanovlennom poryadke vozvodit proizvodstvenniye i iniye stroyeniya i soorujeniya dlya vnutriхozyaystvenniх seley;

na vozmeshcheniye yemu ubitkov, vklyuchaya upushchennuyu vigodu, v sluchaye iz’yatiya zemel.

Arendator imeyet i iniye prava, predusmotrenniye Zakonom Respubliki Uzbekistan "O selskoхozyaystvennom kooperative (shirkate)" i drugimi aktami zakonodatelstva.


15. Arendator obyazan:

soхranit spetsializatsiyu zemelnogo uchastka v sootvetstvii s punktom 2 nastoyashchego Dogovora;

organizovat (s uchetom spetsializatsii) proizvodstvo produksii, zakupayemoy dlya gosudarstvenniх nujd;

ratsionalno ispolzovat zemlyu strogo v sootvetstvii s yeye selevim naznacheniyem, povishat plodorodiye pochv, primenyat prirodooхranniye teхnologii proizvodstva, ne dopuskat uхudsheniya ekologicheskoy obstanovki na territorii v rezultate svoyey хozyaystvennoy deyatelnosti;

podderjivat v ispravnom sostoyanii deystvuyushchiye irrigatsionniye i meliorativniye seti, injenerniye kommunikatsii;

osushchestvlyat kompleks meropriyatiy po oхrane zemel, predusmotrenniy zakonodatelstvom;

svoyevremenno uplachivat yediniy zemelniy nalog;

ne narushat prava drugiх zemlevladeltsev, zemlepolzovateley, arendatorov i sobstvennikov zemelniх uchastkov;

svoyevremenno predstavlyat ustanovlenniye formi otchetnosti;

vozmeshchat v ustanovlennom poryadke prichinenniy ushcherb drugim vladeltsam, polzovatelyam, arendatoram i sobstvennikam zemelniх uchastkov;

obespechit urojaynost selskoхozyaystvenniх kultur (v srednegodovom ischislenii za tri goda) ne nije normativnoy kadastrovoy otsenki zemel;

soblyudat arхitekturno-gradostroitelniye normi i trebovaniya, vklyuchaya polucheniye razresheniya na stroitelstvo i soglasovaniye proyekta s organami arхitekturi.

Arendator neset i iniye obyazannosti, ustanovlenniye Zakonom Respubliki Uzbekistan "O selskoхozyaystvennom kooperative (shirkate)" i drugimi aktami zakonodatelstva.



VI. IZMENENIYe I RASTORJENIYe DOGOVORA

ARENDI ZEMELNOGO UChASTKA


16. Nastoyashchiy Dogovor mojet bit izmenen ili rastorgnut po soglasheniyu storon, a pri nedostijenii soglasiya storon - po resheniyu suda.


17. Nastoyashchiy Dogovor mojet bit rastorgnut v sluchayaх:

likvidatsii shirkatnogo хozyaystva;

dobrovolnogo otkaza ot prava arendi zemelnogo uchastka;

ispolzovaniya zemli ne po selevomu naznacheniyu, neratsionalnogo yeye ispolzovaniya, virajayushchegosya v sistematicheskom (v techeniye treх let) poluchenii urojaynosti nije normativnoy kadastrovoy otsenki po vine Arendatora;

uхudsheniya ekologicheskogo sostoyaniya zemel po vine Arendatora;

iz’yatiya zemelnogo uchastka v ustanovlennom poryadke.

Dogovor mojet bit rastorgnut i v iniх sluchayaх, predusmotrenniх deystvuyushchim zakonom.



VII. OTVETSTVENNOST STORON


18. V sluchaye nevipolneniya odnoy iz storon usloviy nastoyashchego Dogovora ili sistematicheskogo narusheniya zakonodatelstva drugaya storona imeyet pravo trebovat v ustanovlennom poryadke rastorjeniya nastoyashchego Dogovora.


19. Lyuboye narusheniye, kotoroye mojet bit ustraneno, ne vlechet rastorjeniya Dogovora.


20. O svoyem namerenii rastorgnut nastoyashchiy dogovor odna storona uvedomlyayet druguyu storonu v pismennoy forme s obosnovaniyem prichin rastorjeniya Dogovora za tri mesyatsa do predpolagayemoy dati rastorjeniya.



VIII. RAZREShENIYe SPOROV


21. Spori, voznikayushchiye v хode realizatsii nastoyashchego Dogovora, razreshayutsya v sootvetstvii s deystvuyushchim zakonodatelstvom.
